Disability FAQs
Navigating the disability claims process can be complex and overwhelming. Whether you are a veteran seeking compensation for a service-connected condition or an individual applying for Social Security Disability benefits, understanding the requirements, timelines, and appeal options is crucial. Here we answer some of the most common questions to help you make informed decisions about your claim
Who qualifies for VA disability benefits?
You may qualify if you have a current medical condition that was caused or worsened by your military service and you did not receive a dishonorable discharge.
How does the VA determine my disability rating?
The VA assigns a percentage (0%-100%) based on the severity of your condition and how it impacts your ability to work and perform daily activities.
What if my VA disability claim is denied?
You can appeal through a Supplemental Claim (new evidence), a Higher-Level Review (request a senior reviewer), or a Board Appeal (formal hearing before a judge).
What is the difference between SSDI and SSI?
SSDI (Social Security Disability Insurance) is for individuals with a work history who have paid into Social Security. SSI (Supplemental Security Income) is needs-based for individuals with low income and limited work history. To be eligible for SSDI or SSI, an individual must be unable to work at any job on a regular full time basis, due to severe medical impairments for at least a period of one year.
How do I qualify for SSDI?
You must have worked and paid Social Security taxes, meet the medical eligibility requirements, and prove that your disability prevents you from working.
What happens if my SSDI claim is denied?
You have four levels of appeal: Reconsideration, Hearing, Appeals Council Review, and Federal Court Review.
